Does my product need to have a CE mark? There isn’t a day that goes by that we don’t get asked this question. Unfortunately, it can be challenging to decide whether a product has to be CE marked. Unfortunately, no organization exists that offers a list of products or a classification that identifies the products that need CE. Instead, you must conduct your investigation. We advise doing the next actions.

Do you intend to sell in a nation where CE marking is required?

Products that are sold or put into use in the European Economic Area must bear the CE marking designation. Even yet, as we will see in the following phase, it only really pertains to specific product categories or product features. To determine whether a product has to be CE marked, you must first determine whether the country or countries in which the product will be used or sold are CE-required countries.

The CE marking is required in the countries that together form the European Economic Area (EEA):

  • Austria (became a member in 1995)
  • Belgium (Founder Member in 1957)
  • Bulgaria (2007)
  • Croatia (2013)
  • Cyprus (2004)
  • Czech Republic (2004)
  • Denmark (1973)
  • Estonia (2004)
  • Finland (1995)
  • France (FM 1957)
  • Germany (FM 1957)
  • Greece (1981)
  • Hungary (2004)
  • Ireland (1973)
  • Italy, (FM 1957)
  • Latvia (2004)
  • Lithuania (2004)
  • Luxembourg (FM 1957)
  • Malta (2004)
  • The Netherlands (FM 1957)
  • Poland (2004)
  • Portugal (1986)
  • Romania (2007)
  • Slovakia (2004)
  • Slovenia (2004)
  • Spain (1986)
  • Sweden (1995)

…together with these three EFTA (European Free Trade Association) members:

Iceland, Norway, and Liechtenstein are included.

Switzerland does not participate in the EEA even though it is an EFTA member.

PLEASE NOTE: Neither the EU nor the EEA considers Turkey to be a member. Nevertheless, Turkey has fully complied with many of the CE certification standards from Europe. This implies that CE Marking is also necessary for many products.

Please take note that the UK will no longer require the CE marking and will instead require the UKCA conformity marking following the conclusion of the Brexit process and a transition period.

The product will not require CE marking if it is not intended to be sold in the aforementioned nations.

The next step is to establish which European CE marking directives or rules apply to the goods.

Next, determine whether the product is under the purview of a CE directive or rule.

Only products for which a CE marking directive or regulation has been enacted need to have the CE marking. The following product categories are covered by directives or regulations (please note that more than one directive or rule may apply to a single product)

Do any of the regulations or directives apply to your product? If so, CE marking Certification is required.

Products exempt from the CE

The following goods DO NOT NEED the CE marking:

  • Chemicals
  • Pharmaceuticals
  • Cosmetics
  • Foodstuffs

Other EU or national laws may apply to products that are not covered by the European CE marking directives. The General Product Safety Directive (2001/95/EC) may be applicable if there is no applicable CE directive or regulation. Although the General Product Safety Directives do not mandate branding, they do demand that items be safe.
